These terms and conditions apply to all listings or advertising made by any entity (a Listing Company).

1. Listing:

1.1 It remains the responsibility of the Listing Company to provide all required graphic and text elements for the creation of listing on the site.

1.2 The Listing Company grants Functions International a worldwide, royalty free non-exclusive license to publish the listing on the website.

1.3 The Listing Company warrants to Functions International that the listing and the inclusion of the listing on the Website does not breach or infringe the Trade Practices Act (Cth), Fair Trading Act (State) or equivalent legislation or any copyright, trademark or obligation of confidentiality.

2. Payment:

2.1 A binding contract in relation to a request for a listing will only be formed between Functions International and a Listing Company when Functions International accepts the listing in writing or generates a tax invoice for that listing. Such contract includes these terms and conditions.

2.2 Unless otherwise stated, the fee is for a standard listing on the site only, and does not include any other promotional products or services.

2.3 Functions International reserves the right to change pricing structures at any time. Where a Listing Company has already listed for a twelve month period, these will not be subject to an increase.

2.4 Listing Companies may pay via direct deposit, direct debit or credit card (VISA, Mastercard or Bankcard.) Please view our Privacy and Security Policy for credit card payments.

3. Cancellation:

3.1 Functions International reserves the right to reject and/or cancel any application, and/or remove the Listing Company, at any time.

3.2 If cancellation or removal is a result of breach of any of these Terms and Conditions by the Listing Company, all fees for the full term will be immediately payable.

3.3 If a Listing Company chooses to remove from the site in whole or part at any time, there will be no refund provided, except as agreed with Functions International.

4. Renewal

4.1 For renewal purposes listing periods will begin from the day of sign-up and last for a period of twelve months.

4.2 Functions International will send a renewal reminder to the email address provided on the application form approximately 2-3 weeks before the expiry of the advertising period.

4.3 It is the Listing Company’s responsibility to ensure that contact details are updated.

4.5 If a Listing Company has not provided payment before the end of day on the last day of the month Functions International will automatically deactivate the listing.

4.6 After 12 months, the Listing will automatically be rolled over for another 12 months, unless Functions International is notified that the Listing Company wishes to cancel their listing.

6.General

6.1 Functions International reserves the right to alter or change any of the terms and conditions at any time.

6.2 It is the responsibility of the Listing Company to ensure that all material supplied by the Listing Company is the property of the Listing Company and free of copyright restriction.

6.5 The copyright for listing pages (or any advertising element produced for a Listing Company and displayed on site) remain the property of Functions International. Listing Companies are not permitted to take any elements of the design as their own to replicate on a business website, or display on any site other than Functions International.

6.7 Functions International reserves the right to display graphics and other web design elements as examples of their work in appropriate portfolios.

6.8 Functions International is not liable for any loss or damage arising from a failure of the internet or any telecommunications structure.

6.9 The Listing Company acknowledges that it has not relied on any advice given, or representations made by or on behalf of Functions International in connection with the listing.
